In January 2018, former Wynn Resort employees accused respondent Stephen A. Wynn of sexual misconduct in a nationally published article.  After investigating these allegations for several months, the Nevada Gaming Control Board filed a complaint against Wynn, individually, seeking the Nevada Gaming Commission’s revocation of his findings of suitability—a determination issued by the Commission that is required for certain persons involved in the gaming industry—on the grounds Wynn violated Nevada gaming statutes and regulations, and harmed the State of Nevada and the gaming industry’s reputation.  Wynn filed a motion to dismiss the Board’s complaint arguing that the Commission lacked jurisdiction over him, as he had resigned as CEO of Wynn resorts, sold his stock in Wynn resorts, and moved from his residence on the property.  The Commission denied his motion to dismiss and Wynn filed a petition for judicial review or writ of prohibition in the district court.  The district court granted Wynn’s petition for judicial review.  The Board and Commission (collectively, the Agencies) appeal that order, raising the following issues:

ISSUES:

whether (1) the district court lacked jurisdiction to consider Wynn’s petition; and (2) the district court abused its discretion by granting Wynn’s petition based on its finding that the Agencies lacked jurisdiction over Wynn.
