Respondent was charged in 2018 with child abuse, neglect, or endangerment resulting in substantial bodily or mental harm for alleged acts committed upon his daughter. Multiple evaluators and the district court found respondent not competent to stand trial and he was sent to the Stein Forensic Facility for treatment and possible restoration of competency.  After undergoing restoration treatment, he was found competent to stand trial, a finding he challenged. The district court conducted a competency hearing and found respondent “incompetent without the possibility of restoration” and dismissed the charge against respondent without prejudice.

Respondent was charged in 2018 with sexual assault of a minor under 14 years of age and three counts of lewdness with a child under the age of 14.  Multiple evaluators and the district court found respondent not competent to stand trial and he was sent to the Stein Forensic Facility for treatment and possible restoration of competency.  After undergoing restoration treatment, respondent was found competent to stand trial, a finding he challenged.  The district court conducted a competency hearing and found respondent “incompetent without the possibility of restoration” and dismissed the charges against respondent without prejudice.
