Respondent Nevada Voters First PAC seeks to place an initiative on the ballot that would eliminate partisan primaries, with the top five candidates from the primary proceeding to a ranked-voting general election.  Appellant challenged the initiative’s compliance with constitutional and statutory provisions, and the district court denied the challenge.

ISSUES: (1) does the initiative comply with the statutory single-subject requirement; (2) is the initiative an unfunded mandate that violates Article 19, Section 6 of the Nevada Constitution; and (3) does the initiative’s description of effect comply with statutory requirements.

This appeal involves two verified initiative petitions proposing statutory amendments and the sponsoring respondents’ withdrawal of the initiative petitions.  The district court issued writs of mandamus and prohibition compelling appellant Secretary of State to recognize the sponsoring respondents’ withdrawals.

ISSUES:

Appellant argues that a verified initiative petition may not be withdrawn and that she is constitutionally mandated to place the initiatives on the general election ballot.  Accordingly, she argues that the statute setting forth the withdrawal procedure, NRS 295.026, is unconstitutional.  Respondents argue that the Legislature was authorized to enact statutes facilitating the initiative-petition process and that NRS 295.026 is a constitutional exercise of that power.  They further argue that a withdrawn petition is void and that the district court therefore appropriately granted writ relief to bar appellant’s taking further action on the withdrawn initiative petitions.
