In their criminal appeals in district court, real parties in interest Jennifer Plumlee and Matthew Molen argued their misdemeanor criminal convictions were invalid due a separation-of-powers violation—Deputy District Attorney Melanie Scheible’s dual service as a legislator and employee of the Clark County District Attorney’s Office. The district court agreed and vacated the convictions.

ISSUES:

The State challenges the district court’s decisions.

APARICIO (HENRY) VS. STATE

This is a petition for review of a court of appeal’s order vacating appellant’s sentence and remanding to the district court for resentencing before a different judge.  Appellant challenged his judgment of conviction, based on a guilty plea, for two counts of driving under the influence resulting in death and felony reckless driving.

ISSUES:

Here, we consider whether (1) all of the “victim” impact letters fall under the broader definition of “victim” as set forth in Marsy’s Law, and (2) whether the court of appeals properly concluded that the district court’s error was not harmless.
