This is a writ petition challenging pretrial release protocols.

ISSUES:

Petitioner Derek Johnston argues that: (1) defendants are entitled to a prompt hearing when they are remanded into custody for allegedly violating their terms of pretrial release; (2) a probable cause determination must be supported by credible evidence and the State bears the burden of proof; (3) there is a distinction between “technical” and “substantive” violations of pretrial release conditions; (4) the district court must determine the least restrictive means of protecting the community and ensuring a defendant’s return to court; (5) the district court erred by requiring Johnston to post bail and submit to the terms of house arrest; (6) these issues fall under the exception to the mootness doctrine; (7)  he lacks an adequate remedy at law; and (8) the issues presented are of statewide importance.
