Airbnb, Inc. vs. Rice

This case arises out of a shooting that occurred at a residence in Las Vegas, Nevada, booked through appellant Airbnb Inc.’s website.  Bryan Lovett and Raheem Rice were shot while en route to a party held at the residence.  Raheem Rice died.

ISSUES:

Respondent Bryan Lovett, and respondents Eric Rice and Jefferson Temple, as special administrator of the estate of Raheem Rice (collectively, Rice), sued Airbnb and other defendants for negligence.  Before filing an answer, Airbnb moved to compel arbitration pursuant to its website’s Terms of Service (TOS), arguing that the parties were bound to arbitration under the TOS’s arbitration clause because both Raheem Rice and Eric Rice accepted the TOS when creating Airbnb accounts.  The district court denied the motion as to all plaintiffs.  Airbnb appeals the denial as to Eric Rice and Raheem Rice’s estate.

Uber Tech., Inc. vs. Royz

The underlying case arises from a traffic accident involving two Ubers. The passengers brought claims against Uber, its subsidiary Raiser, and both drivers.

ISSUES:

The issue on appeal is whether the terms and conditions of Uber’s agreement delegate threshold issues of arbitrability to the arbitrator and, if so, whether the district court erred by deciding the disputed questions of arbitrability under the facts of this case.

Hall (Bryan) vs. State (Death Penalty-PC)

Appellant Bryan Hall was convicted of first-degree murder with the use of a deadly weapon and robbery.  The jury sentenced him to death for the murder.  This court affirmed Hall’s convictions and sentence on direct appeal.  He then filed a postconviction petition for a writ of habeas corpus alleging that he received ineffective assistance of trial and appellate counsel.  The district court denied the petition.  This appeal followed.

ISSUES:

The primary issues in this appeal are whether Hall received ineffective assistance of trial and appellate counsel.
