This appeal and a cross-appeal arise from a district court summary judgment finding that two bills approved by the Legislature in 2019, Senate Bills 542 and 551, were subject to the Nevada Constitution’s supermajority provision, Nev. Const. art. 4, § 18(2). Because the bills were passed by a simple majority, the district court declared them unconstitutional.

ISSUES:

Appellants/cross-respondents challenge the district court’s conclusion that that the bills were subject to a supermajority vote. Respondents/cross-appellants challenge the district court’s denial of their request for attorney fees and costs from certain individual parties named in their official capacities, as well as the dismissal of those parties from the action below.
