Appellant Ramon Dorado was convicted of three counts of sexual assault stemming from an incident that occurred on or about April 24, 1999.  The victim’s rape kit, completed in 1999, remained untested until 2016, about 17 years after the assault occurred, at which time Dorado was identified as a potential match.  Dorado was charged by way of indictment on April 27, 2017.

ISSUES:

On appeal, Dorado first argues that the district court abused its discretion by denying his motions to dismiss because the following errors warrant dismissal: (1) preindictment delay, (2) the State’s failure to collect and preserve evidence, and (3) the district court lacked jurisdiction.  Dorado next argues that the district court abused its discretion (4) by denying his Batson challenge and (5) by limiting testimony from his expert witness.  Additionally, Dorado contends that (6) the prosecutor committed misconduct by shifting the burden of proof to the defense and commenting on his failure to testify.  Finally, Dorado argues that (7) cumulative error warrants reversal.
