The Las Vegas Review-Journal sought $279,221.48 in attorney fees and costs after litigating a Nevada Public Records Act request.  The district court found that LVRJ was entitled to fees and costs and that the Brunzell factors tilted in LVRJ’s favor; but the court then reduced the amount sought by almost 40%, stating that it did so based on its experience in insurance litigation and its review of LVRJ’s paperwork.

ISSUES:

The question presented is whether this statement adequately explains the amount awarded.

Mitchell vs. Nype

This is an appeal from a district court order entering judgment in favor of respondents, Russell Nype and Revenue Plus, LLC (collectively Nype), on claims against Barnet Liberman, and appellants, David Mitchell, Las Vegas Land Partners (LVLP), and other related entities owned by Mitchell and Liberman.  Nype, in a previous lawsuit, obtained a judgment against LVLP and other related entities (LVLP Plaintiffs) for services provided for a certain real estate development transaction.  After being unable to successfully satisfy their original judgment against the LVLP Plaintiffs, Nype brought the present suit against Mitchell, Liberman, LVLP, and other related entities (collectively the Mitchell Parties) on claims of fraudulent conveyance, civil conspiracy, alter ego liability, constructive trust, and declaratory relief, asserting that the Mitchell Parties had conspired to prevent Nype from collecting his original judgment against the LVLP Plaintiffs.  The district court found in favor of Nype on his claims of fraudulent conveyance, civil conspiracy, and alter ego liability and awarded Nype attorney fees and prejudgment interest.  On appeal the Mitchell Parties raise a variety of challenges regarding each aspect of the district court’s order.

ISSUES:

The three primary issues on appeal are whether the: (1) district court’s judgment for civil conspiracy, fraudulent conveyance, and alter ego liability are supported by substantial evidence, (2) compensatory damages awarded by the district court was an abuse of its discretion, and (3) district court’s award of attorney fees was a manifest abuse of discretion.
