This case arises from the Foreclosure Mediation Program (FMP).  Appellant-homeowner filed a petition for foreclosure mediation assistance in June 2018.  The matter went to mediation, but the parties were unable to agree on a loan modification, and the mediator terminated the mediation and recommended dismissal of the petition.  The mediator, however, noted that respondent-lender, which was to bring certain documents to the mediation, did not timely provide a second appraisal on the property, and that the short sale amount given at mediation was not based on the new appraisal.  The homeowner filed a petition for judicial review, and the lender filed a competing request for appropriate relief based on its compliance with the FMP Rules.

ISSUES:

The district court denied the petition for judicial review and granted the lender’s request for relief, finding that the mediator erred in finding the lender failed to provide certain documents or a short sale amount.  The district court therefore ordered a certificate of foreclosure to issue.  The homeowner now appeals.
