This is an appeal from a district court order denying an NRCP 60(b) motion for relief from a default judgment.  Respondent obtained a default judgment against appellant, and thereafter, appellant filed a motion for NRCP 60(b) relief, arguing that she had only recently learned of the default judgment.  The district court denied the motion on the ground that it was untimely filed.  Issues on appeal: (1) whether appellant’s NRCP 60(b) motion should be construed as an NRCP 60(b)(1) motion or an NRCP 60(b)(4) motion; (2) whether the default judgment is void due to defective service of process; and (3) whether the case should be dismissed for lack of personal jurisdiction.

After completing service of the summons and complaint for divorce by publication, appellant obtained a divorce from respondent by default.  Nearly three years later, while appellant and respondent still lived as a married couple, respondent learned about the divorce and moved to set it aside because she was not personally served with the complaint for divorce and summons despite respondent knowing of her location.  The district court granted respondent’s motion and set aside the divorce decree.  Issues: (1) does this court have jurisdiction over this appeal; and (2) did the district court abuse its discretion in granting relief under NRCP 60.
