This is an appeal of a final judgment in a contract and tort case involving a breaching tenant and a landlord seeking to recover damages.  Weingarten, Nostat, Inc. is a national lessor of commercial properties.  It leased a location in a shopping center in Henderson, Nevada to Mr. “D,” LLC, which operated a donut shop.  Business took a downturn and Mr. “D”, attempted to assign his lease and sell the building to a third party before abandoning the premises.

ISSUES:

Among the disputes in this case is the ownership of the leasehold improvements (i.e., a building constructed by the tenant).   Another dispute between the parties is whether a landlord is obligated to send third parties who might be interested in the location to the current tenant, or if such failure is intentional interference with a potential economic advantage.
