DRASKOVICH VS. DRASKOVICH

Las Vegas – 4:00 P.M. – Cadish/Pickering/Stiglich

DRASKOVICH VS. DRASKOVICH

Docket No. 84998

Las Vegas – 4:00 P.M. – Cadish/Pickering/Stiglich

This is an appeal and cross-appeal from a district court’s judgment in a divorce proceeding.  Respondent/cross-appellant Laurinda Draskovich and appellant/cross-respondent Robert Draskovich, Jr. were married in 2012 and filed for divorce in 2021.  Robert is a practicing criminal defense attorney in Las Vegas.  At the time of the marriage, Robert was a partner at Turco & Draskovich (T&D) but dissolved that partnership and incorporated the Draskovich Law Group (DLG) during the marriage. The divorce proceeded to a two-day trial.  DLG was the primary asset in dispute at trial.  The district court determined that because DLG was incorporated during the marriage, it was community property, and DLG did not represent a continuation or Robert’s pre-marriage legal practice.  The district court further concluded that Robert failed to provide evidence regarding a separate property component, rendering DLG entirely community property. Laurinda also sought alimony from Robert.  The district court, after analyzing the factors outlined in NRS 125.150(9), concluded that Laurinda was not entitled to any alimony.  Robert and Laurinda now appeal.
