This case tests the State Engineer’s authority to regulate the drilling of new domestic wells in an over-appropriated, statutorily “designated” basin. By order issued December 2017, later amended on July 12, 2018, the State Engineer “prohibited the drilling of any new domestic well” in the Pahrump Valley Hydrographic Basin, unless the landowner first obtains, and then relinquishes, 2 acre feet annually (afa) of existing rights in the basin—2 afa being the amount statutorily allowed for a domestic well under NRS 534.180(1).
ISSUES:
The district court invalidated the State Engineer’s order on multiple grounds, including that the State Engineer lacked statutory authority to restrict domestic-well drilling under NRS 534.180 and erred in issuing the order without affording interested landowners notice and the opportunity to be heard. The State Engineer appeals and urges in support of reversal the provisions in NRS 534.110(8) and NRS 534.120(1).
