Appellant appeals his judgment of conviction, pursuant to a jury verdict, of murder (second degree) with use of a deadly weapon, attempt murder with use of a deadly weapon, robbery with use of a deadly weapon, and grand larceny auto. Appellant argues that the district court committed numerous errors warranting reversal. Appellant further argues that this court should consider adopting a heightened standard for determining if a criminal defendant is capable of self-representation.

Appellants are a lithium mining company and the State Engineer who both appeal a district court order granting judicial review and vacating the State Engineer’s grant of the mining company’s application for an extension of time to show beneficial use of water rights. Respondent is another mining company seeking water rights, arguing that the district court correctly determined that the State Engineer erred in granting the extension of time.
