Oshiro vs. Oshiro (Family)
Docket No. 89205
Las Vegas – 11:00 a.m. – Panel B
This is an appeal from an amended divorce decree awarding alimony. Appellant argues that the district court erred because NRS 125.165 prohibits courts from considering parties’ access to military disability benefits when calculating alimony awards. Appellant also argues that NRS 125.150(1)(b) requires courts to provide a compelling reason for requiring one party to pay an unequal share of the parties’ available income to satisfy their alimony obligation. Respondent counters that courts may consider a veteran spouse’s military disability benefits within alimony calculations and that the district court’s alimony award was not an abuse of discretion.
Parler LLC vs. Matze
Docket No. 86495
Las Vegas – 11:45 a.m. – Panel B
After being fired from a social media company, Parler, the company’s former CEO discussed the conditions of his firing on national news. In response, a media personality associated with Parler published a video in which he countered the former CEO’s narrative and accused the former CEO of lying. In response, the former CEO filed claims of defamation and conspiracy to defame against the media personality and other individuals and entities associated with Parler. All defendants filed anti-SLAPP motions to dismiss, which the district court denied. Defendants now appeal this denial of the anti-SLAPP motions to dismiss.
