The district court entered an order sentencing appellant to 28 to 72 months in prison pursuant to a jury verdict that found appellant guilty but mentally ill on count three of a three-count information.  Appellant challenges the order, arguing that because he was also found not guilty by reason of insanity on the two other counts arising out of the same events, he should be committed to the custody of the Department of Public and Behavioral Health under NRS 175.539.  He further contends that his sentence on the guilty but mentally ill conviction should be reduced to probation so that he can serve the civil commitment requirements concurrently with his sentence.

This petition arises from a personal injury case in which the district court ordered the defendants’ expert to disclose psychological test data associated with the expert’s examination report.  Petitioners seek writ relief from the order, arguing that NAC 641.234(3) prohibits disclosure.
