Appellant Mohamed Jimale was severely injured in a vehicular collision while riding in the cabin of a truck.  He obtained a default judgment for his injuries against the estate of the driver, who died in the crash, and attempted to enforce the judgement against Spirit Commercial Auto Risk Retention Group, Inc., which provided automobile insurance coverage for Cargo Transportation, LLC.  With Spirit in financial distress unrelated to the accident, respondent the Nevada Commissioner of Insurance placed Spirit in receivership and then appointed a Receiver who denied Jimale’s claim, citing a provision in the insurance policy that excluded coverage for claims that would be covered by workers’ compensation.  The district court upheld the Receiver’s determination, concluding that Jimale’s injury occurred in the scope of employment and thus was excluded from coverage. Jimale  appeals.
