Appellant challenges his convictions for attempted murder with the use of a deadly weapon, discharging a firearm at an occupied vehicle, discharging a firearm in a place where another person may be endangered, and murder with the use of a deadly weapon. Appellant was convicted for shooting at a moving vehicle in an alleyway on March 11, 2021, and for murdering a man near a gas station on March 22, 2021. ISSUES: whether (1) the district court abused its discretion by refusing to sever the March 11 counts from the March 22 counts; (2) the district court erroneously instructed the jury on challenge-to-fight murder; (3) appellant’s convictions for discharging a firearm at an occupied vehicle and for discharging a firearm in a place where a person may be endangered merge; (4) sufficient evidence supports the convictions for attempted murder and murder; (5) the admission of other act evidence rendered appellant’s trial unfair; (6) the district court abused its discretion by excluding a defense expert; (7) the district court’s questioning and removal of a juror for failing to follow instructions prejudiced appellant; and (8) cumulative error warrants reversal.

Petitioner, Burke Construction Group, Inc., petitions for a writ of mandamus compelling the district court to vacate an order denying summary judgment and enter an order granting summary judgment. Petitioner argues that the district court should have granted its motion for summary judgment because it cannot be held liable for third-party indemnification and contribution for injuries to its employee under the Nevada Industrial Insurance Act.
