This is an appeal from a district court’s acceptance of judgment from the Nevada Short Trial Program. Appellant Vegas Aqua, LLC entered into a facilities rental agreement with Anthony Rivera—a purported agent of the Respondent Jupitor Corp.—to provide a yacht for an event being planned by Rivera. Fiscal Group, a third party, tendered a $18,280 down payment. The event was later cancelled due to the COVID-19 pandemic, prompting Jupitor Corp. to request a refund of the down payment. Vegas Aqua refused Jupitor Corp.’s request. Jupitor Corp. subsequently initiated the underlying action. After mandatory arbitration in favor of Jupitor Corp., the case was transferred to the Nevada Short Trial Program. The short trial judge denied Vegas Aqua’s motion for summary judgment and, after the short trial, entered her decision in favor of Jupitor Corp. on claims of unjust enrichment and money due and owing. The district court reviewed and approved the short trial judge’s decision. The short trial judge also ruled on and denied Vegas Aqua’s objection to the entry of judgment and its NRCP 59 motion to alter or amend the judgment, or for new trial. Vegas Aqua appeals the lower court’s judgment, arguing the short trial judge (1) exceeded her authority under Nevada Short Trial Rule 3(d) by ruling on Vegas Aqua’s objection and NRCP 59 motion; (2) erred in denying Vegas Aqua’s motion for summary judgment; (3) made procedural and substantive errors in her short trial decision that require reversal; and (4) committed reversible error in her order denying Vegas Aqua’s NRCP 59 motion.
