This is an appeal from a district court order denying a preliminary injunction and dismissing a complaint alleging that a provision of SB 329 (2021), NRS 598A.440, is facially unconstitutional. Appellants argue that the complaint gave fair notice to respondents of the nature of the claim and that the district court erred by dismissing the complaint for failure to state a claim without allowing development of a sufficient factual record for the court to properly assess its dormant Commerce Clause based claim.
