This is an appeal from a district court order vacating an arbitration award in a realtor association dispute.  An arbitration panel of the Greater Las Vegas Association of Realtors (GLVAR) granted an arbitration award in favor of appellant SVRE, LLC (Simply Vegas) regarding a brokerage commission dispute with respondent Queensridge Reality, LLC (Queensridge) over the sale of a property.  An appellate panel of GLVAR affirmed the arbitration award.  Queensridge filed a motion to vacate the arbitration award with the district court.  The district court granted Queensridge’s motion and vacated the arbitration award on the ground that the arbitration panel disregarded or misapplied Nevada law in reaching its decision to grant the arbitration award.  Simply Vegas appealed.

ISSUES:

ISSUES: Whether: (1) the district court correctly applied the proper standard of review in determining whether to confirm or vacate the arbitration award, and (2) the arbitration panel disregarded applicable Nevada law and GLVAR guidelines in reaching its decision.

Solander (Janet) vs. State

This is an appeal from a judgment of conviction, pursuant to a jury verdict, of two counts of battery with intent to commit sexual assault; three counts of assault with use of a deadly weapon; five counts of child abuse, neglect or endangerment with substantial bodily harm; eleven counts of sexual assault of a minor under 14 years of age; and twenty-five counts of child abuse, neglect or endangerment.  The convictions stem from appellant Janet Solander’s abuse of her three adopted children.

ISSUES:

The primary issues on appeal are: (1) whether the State presented sufficient evidence to support the jury’s verdict of guilty to the charge of sexual assault by means of catheterization; (2) whether the charging document provided Solander with sufficient notice to defend against the alleged criminal conduct; (3) whether the district court erred by rejecting Solander’s proffered jury instructions on the definition of sexual penetration and mistake of fact; and (4) whether the district court erred by admitting prior-bad-act evidence regarding Solander’s treatment of other foster children.

Matthews (Jemar) vs. State

Mersy Williams was standing outside of a home when she was shot and killed after a group of men opened fire on the home.  The shooters carjacked a vehicle and fled the scene.  Police pursued and the driver exited the vehicle and fled on foot.  A K9 found Matthews hiding in some bushes nearby and alerted officers to Matthews as the suspect.  Officers who chased the getaway car also identified Matthews as the driver.  A jury found Matthews guilty of murder.

ISSUES:

The issues on appeal are: (1) whether the district court erred in denying Matthews’ Batson challenge, (2) whether the State committed prosecutorial misconduct by vouching for the reliability of lead witnesses in closing, (3) whether the district court abused its discretion by allowing a K9 officer to testify as a lay and expert witness, and (4) whether the district court erred by denying a defense witness’s testimony because the witness was untimely disclosed.

Yandell (Timothy) vs. State

This case presents a timely appeal from a conviction on two counts—robbery with a deadly weapon (NRS 200.380, 193.165), and robbery with a deadly weapon, victim over the age of 60 (NRS 200.380, 193.165, 193.167) —stemming from appellant showing a fake firearm to two employees of a Napa Auto Parts store before walking away with unpaid store merchandise.

ISSUES:

Yandell seeks to have his conviction reversed based on (1) the State’s striking two black female venirepersons; (2) the State’s supposed withholding of evidence favorable to the defense; (3) the district court’s allegedly erroneous evidentiary rulings; (4) the district court’s failure to dismiss a redundant criminal charge; (5) insufficient evidence; (6) prosecutorial misconduct; (7) errors in jury instructions and the verdict form; and, (8) cumulative error.
