A jury convicted Wayne Cameron of the first-degree murder of Jarrod Faust, who was found shot dead in his truck.  The issues raised by the parties are whether (1) the district court erred when it allowed a conviction on a theory of felony murder where the felony was not proven; (2) the information was constructively amended by the jury instructions; (3) the district court improperly admitted other act evidence of two prior road rage incidents; (4) the court improperly allowed the victims to make sentencing recommendations; (5) the court improperly admitted other act evidence of two prior shootings during the sentencing phase; and (6) the final sentence of NRS 200.030(4) is unconstitutional.

Appellants are riparian owners of littoral parcels along Lake Tahoe.   Appellants challenge the annual permit fee for piers ($750) and buoys ($250) that is now set by regulation instead of by statute.  The State Land Registrar set the fee for piers and buoys uniformly throughout the state after consulting multiple methods. The issues raised on appeal are the following: (1) Did the district court err in applying a deferential “clearly illegal” standard of review and also rejecting “arbitrary and capricious” review in analyzing a Division regulation concerning permit fees for piers and buoys over state-owned, submerged land?  (2) Did the district court err in holding that the regulation does not exceed nor violate the Division’s statutory authority? (3) Did the district court erroneously impose on Petitioners a burden to propose an alternative rule in order to prevail in their challenge to the regulation?
