Gladys Turner fell while hospitalized at Renown Regional Medical Center.  She died several days after the fall.  Almost two years later, her son filed a complaint against Renown Regional Medical Center and Renown Health.  Although the Turners labeled the claims as negligence, the district court found that the claims sound in medical malpractice and dismissed the complaint based on the statute of limitations.

ISSUES:

On appeal, the Turners argue that the district court (1) erred when it determined that the claims sound in medical malpractice instead of negligence; (2) abused its discretion when it granted Renown’s pretrial motions, and (3) abused its discretion when it awarded Renown costs.
