IN RE: I.S.

Docket No. 86035

Carson City – 11:00 a.m. – Cadish/Pickering/Bell

This is an appeal from a juvenile court order affirming and adopting a master’s recommendations to adjudicate appellant a delinquent child and to impose formal probation conditions.  The order was entered after the court found that the requirements of NRS 62C.200, as incorporated in NRS 62C.230, do not create an unconstitutional prosecutorial veto that infringes on the juvenile court’s sentencing discretion.  Appellant challenges the decision, arguing that NRS 62C.200(1)(b) violates the separation of powers between the executive and judicial branches by not allowing a juvenile court to dismiss a delinquency petition and refer a child to informal supervision without written consent from the district attorney.
