This is a petition for a writ of mandamus in a shareholder derivative action.

Petitioners request this court overturn the district court’s finding that petitioners’ requested discovery was protected by Nevada’s attorney-client common interest exception to confidential communications or alternatively was protected by the work product disclosure exception detailed by this court in Cotter v. Eighth Judicial District Court, 134 Nev. 247, 416 P.3d 228 (2018).

These are consolidated appeals from a district court order quashing service and dismissing a negligence complaint and a post-judgment order awarding attorney fees.  Appellant previously sued respondent because respondent closed appellant’s savings account and credit card, in 2013, without his consent.  Approximately three years after that action resolved, appellant brought a second action against respondent alleging that respondent had made false reports about his credit card to credit reporting agencies.

ISSUES:

The issues on appeal are whether: (1) the district court erred in dismissing appellant’s claim on the grounds of issue and claim preclusion, accord and satisfaction, and the expiration of the applicable statutes of limitations; (2) the district court abused its discretion in quashing service of the summons and complaint; and (3) the district court abused its discretion in awarding respondent its attorney fees.

This is an appeal from a jury conviction on charges of assault, coercion with a deadly weapon, and kidnapping.  Appellant contends several errors require this court to reverse appellant’s conviction and remand for a new trial.

ISSUES:

He argues his conviction should be overturned because: (1) the district court improperly instructed the jury; (2) the district court and his counsel violated his constitutional rights; (3) the State presented insufficient evidence to sustain his convictions; (4) the State committed prosecutorial misconduct; and (5) cumulative error warrants reversal.
