This is a direct appeal from a judgment of conviction and an appeal of a district court order denying a motion to reconstruct the record and motion for a new trial. On appeal, appellant argues that there was insufficient evidence to convict him of robbery due to an error in the charging document.
ISSUES:
Additionally, appellant argues that the district court committed a number of errors by: (1) denying his fair-cross-section challenge to the venire, (2) limiting his reserved opening statement, (3) allowing an in-court identification, (4) refusing to give a lost evidence instruction, (5) refusing to give a petit larceny instruction, (7) mishandling a jury note that suggested confusion about an element of the offense charged, (8) not allowing the trial judge to hear his post-verdict motions, (9) denying his motion for a new trial based on newly discovered evidence, (10) denying his motion to reconstruct the record, and (11) committing cumulative errors that rendered his trial fundamentally unfair.

Abebaw Tesfaye Kassa appeals from a judgment of conviction, of first-degree murder but mentally ill and first-degree arson but mentally ill, after jury trial.
ISSUES:
On appeal, Kassa contends that the district court erred by (1) denying his motion to vacate the guilty verdict and find him not guilty by reason of insanity and by (2) instructing the jury on voluntary intoxication.
