79977-COA GOAD (RALPH) VS. STATE
Docket Number: 79977-COA
Las Vegas - 1:30 P.M. - Court of Appeals

Appellant, Ralph Edmond Goad, appeals from a judgment of conviction, pursuant to a jury verdict, of murder with the use of a deadly weapon. Goad claims that the district court denied him due process of law when it failed to order a competency hearing after learning that Goad was deprived of his daily medication, refused to acknowledge his counsel thereafter, and lost his ability to speak. Goad further contends that the district court abused its discretion by admitting evidence of his finances because the evidence was prior bad act evidence. Lastly, Goad argues that the district court abused its discretion when it admitted photographs of the victim’s bloody shirt with holes from the victim’s stab wounds because it was unfairly prejudicial.

ISSUES:

ISSUES: Whether the district court abused its discretion (1) by failing to order a competency hearing when reasonable doubt arose regarding Goad’s competency on the third and/or fourth day of trial; (2) by admitting evidence related to Goad’s financial situation; and (3) by admitting photographs of the victim’s clothing.
