The parties, Jordan and Sarah, have two minor children, J.C and A.C.  Jordan and Sarah never married.  Jordan and Sarah both filed complaints seeking primary physical custody of the children.  The cases were consolidated, and Sarah’s case was made the lead case. A 6-day trial was held on the matter. Following the hearing, the district court entered an order granting Sarah primary physical custody and created a hybrid legal custody arrangement.  Jordan now appeals the district court’s order.  The issues on appeal include whether: (1) the district court considered inadmissible evidence regarding a nolo contendere plea, a child dependency case, and a Child Protective Services report; (2) the district court abused its discretion in awarding Sarah primary physical custody; (3) the district court abused its discretion in creating the hybrid joint legal custody arrangement; and (4) whether the district court erred in its calculation of Jordan’s child support obligation.

This is a pro bono program appeal from a district court order granting summary judgment in a personal injury case. Appellant Isaac Zimmerman was riding his bicycle in a parking lot owned by Respondent Crossroads Commons when he fell off his bicycle and sustained injuries to his face. Isaac filed a civil complaint for negligence, negligence per se, and negligence via res ipsa loquitur against Crossroads Commons. Isaac alleged that a speed bump and/or a banana peel in the parking lot caused him to fall. Crossroads Commons moved for summary judgment. The district court granted summary judgment against Isaac. Following summary judgment, the district court also granted attorney fees and costs to Crossroads Commons as the prevailing party. The issues before the court are whether: (1) the district court properly granted summary judgment on the issue of causation; and (2) the district court properly granted attorney fees under the applicable law.
