This presentation will help Courts better understand the complex aspects of refuse/resist dynamics the and how to address from the Bench. Custody cases are particularly challenging as Family Court professionals’ endeavor to separate fact from allegation, in the quest for the best interests of the children involved. When children present with resistance to spending time with one parent, or outright refuse to participate in parenting time, lawyers, custody evaluators, and courts look for the reasons why and then try to find solutions. For litigators, it can be a matter of proving to the court that one parent has undermined the relationship of the other with their child, or proving that the disfavored parent has engaged in a pattern of behavior that has led to the child to not want to be with them, or possibly something else. Resist-Refuse cases can quickly lead to entrenched dysfunctional behavior and severe impairment of children’s ability to function. Assessment is an important tool for assisting families, being mindful that the process may become so burdensome that relationships become unrecoverable. Practical strategies, including a broader conceptual model, integrating assessment into intervention, effective assistance from the court, and professional development will be addressed.

Many limited jurisdiction courts are addressing the relatively new challenges of jury trials for domestic violence cases, due to the Andersen decision. Many district court judges are new to the bench or have not conducted jury trials since the pandemic erupted.  Where do you start if you haven’t had much experience with jury trials?  What Are the concerns about how jurors are selected? How do you handle motions and objections?  What about jury instructions and verdict forms?  Do you use a current bench book?  While emphasis will be on the challenges faced by the limited jurisdiction courts, all will be welcome to this interactive session.  Chief Judge Michael Gibbons, will lead a team, including Justice Lidia Stiglich, Judge Melisa De La Garza, Judge Scott Freeman, and others, in focusing on the diverse elements of a jury trial.
