Appellants/cross-respondents Reno Real Estate Development, LLC and Reno Property Manager, LLC (collectively, the Developers) and the City of Reno entered into a development agreement to create Reno’s Neon Line District. Respondent/cross-appellant Scenic Nevada, Inc. (Scenic), opposed the agreement. The agreement was approved by the Reno City Council and adopted as Ordinance 6610. Scenic contends that the “Area Identification Signs” within the agreement are billboards that violate Reno’s sign codes and that Developers lack a legal or equitable interest in the land because Developer’s affiliates, rather than Developers themselves, own certain parcels contained within the agreement. The district court found two of the three signs violated the sign codes and prohibited the City from issuing permits for the signs. The district court otherwise left the agreement undisturbed, concluding that the developers had a legal or equitable interest in the parcels owned by their affiliates. The Developers and the City appeal, arguing that Scenic lacks standing to challenge the agreement and that the district court erred in re-classifying the signs. Scenic cross-appeals, arguing that the district court erred in ruling that the Developers had legal or equitable interest in land owned by its affiliates and that mandamus is the proper remedy when a petitioner cannot satisfy the requirements of NRS 278.3195(4).
