In August 1998, appellant Donte Johnson, accompanied by Sikia Smith and Terrell Young, went to a Las Vegas home to steal money and drugs. Not finding either, Johnson shot to death the four occupants of the residence. He was found guilty of four counts of first-degree murder with the use of a deadly weapon and associated offenses and was sentenced to death for each murder. On appeal, this court upheld the convictions but vacated the death sentences and remanded for a new penalty hearing. Johnson v. State, 118 Nev. 787, 59 P.3d 450 (2002). Johnson was again sentenced to death for each murder and this court upheld the death sentences on appeal. Johnson v. State, 122 Nev. 1344, 148 P.3d 767 (2006). He subsequently filed a postconviction petition for a writ of habeas corpus, which the district court denied after conducting an evidentiary hearing. ISSUES: (1) Whether Johnson’s ineffective-assistance-of-counsel claims related to the guilt phase of his June 2000 trial are procedurally barred, and (2) whether the district court erred by denying his claims of ineffective assistance of counsel. This is an appeal from a post-divorce decree district court order denying a motion for reconsideration, a new trial, or to amend or set aside a judgment in custody matter. Pursuant to their divorce decree, appellant Jennifer Gordon (Mother) and respondent Matthew Geiger (Father) shared legal custody of their two minor children, Mother was awarded primary physical custody, and Father received limited visitation. At an evidentiary hearing held several years following the issuance of the decree, the district court sua sponte ordered an increase in Father’s visitation, which triggered Mother’s motion. ISSUES: Whether the district court abused its discretion in denying Mother’s motion for new trial. This is an appeal from a district court order denying a motion to confirm arbitration as to respondent Robert Houchin and a district court order granting a motion to dismiss as to Precision Dental Professionals, LLC, for lack of jurisdiction. ISSUES: (1) Whether the court improperly reviewed an arbitrator’s decision to bind nonsignatories to arbitration, (2) whether the district court erred when it determined that the arbitrator lacked jurisdiction over a party based on the invalidity of an ancillary contract, and (3) whether personal jurisdiction based on consent exists when a party has agreed to arbitrate in Nevada.
